#FightRacism เปิดตัวรายงานสถานการณ์ในประเทศไทยสำหรับคณะกรรรมการว่าด้วยการขจัดการเลือกปฏิบัติทางเชื้อชาติแห่งสหประชาชาติ (CERD)!
🚨 ในปี 2018 ประเทศไทยขึ้นอันดับ1ประเทศที่มีความเหลื่อมล้ำทางเศรษฐกิจมากที่สุดในโลก ทำให้ประเทศไทยกลายเป็นสวรรค์ที่สุขสบายแค่สำหรับthe richest 1% ในขณะที่คนรวยกอบโกยทรัพย์สิน คนจนก็จนลงทุกวัน และกลุ่มคนที่อยู่ล่างสุดของพีระมิดความเหลื่อมล้ำทางเศรษฐกิจนี้ก็คงจะเป็นใครไปไม่ได้นอกจากกลุ่มคนชายขอบของประเทศไทย ไม่ว่าจะเป็นชาวอีสาน กลุ่มชาติพันธุ์ ชาวมลายูมุสลิมในสามจังหวัดชายแดนภาคใต้ ผู้ลี้ภัย หรือ กลุ่มแรงงานข้ามชาติ โดยเฉพาะผู้หญิงและผู้มีความหลายหลายทางเพศในกลุ่มเหล่านี้ที่ถูกผลักไปอยู่จุดที่ต่ำที่สุดในชั้นสุดท้ายพีระมิด
📣 เราจะแก้ปัญหานี้ได้อย่างไร? วันนี้ ประเทศไทยเข้าร่วมกระบวนการทบทวนสถานการณ์การเลือกปฏิบัติทางเชื้อชาติ (Committee on the Elimination of Racial Discrimination - CERD) ซึ่งเป็นกระบวนการทางสิทธิมนุษยชนของสหประชาชาติที่จะตรวจสอบว่ารัฐบาลไทยได้ทำตามพันธะหน้าที่ในอนุสัญญาระหว่างประเทศว่าด้วยการขจัดการเลือกปฏิบัติทางเชื้อชาติ (International Convention on the Elimination of Racial Discrimination - ICERD) หรือไม่ เนื่องในโอกาสนี้ ทางมูลนิธิมานุษยะจึงทำการเปิดตัวรายงาน Joint Civil Society Shadow Report เพื่อรายงานสถานการณ์การการเลือกปฏิบัติทางเชื้อชาติในประเด็นต่างๆของประเทศไทยโดยเฉพาะในกลุ่มรากหญ้าและกลุ่มคนชายขอบแก่คณะกรรมการฯ
✊🏼 ทำไมกระบวนการนี้ถึงสำคัญ? ในฐานะที่ประเทศไทยเป็นภาคีของอนุสัญญาฉบับนี้ รัฐบาลไทยมีข้อผูกพันธ์ทางกฏหมายที่จะต้องปฏิบัติตามอนุสัญญาฯ เพื่อปกป้องและคุ้มครองสิทธิมนุษยชนตามที่มีการบัญญัติเอาไว้ในอนุสัญญาฯ โดยผลลัพธ์ของกระบวนการนี้จะมาในรูปแบบของ ‘ข้อสังเกตเชิงสรุป’ หรือ Concluding Observations ของคณะกรรมการฯ ซึ่งจะให้ ‘ข้อแนะนำ’ แก่รัฐบาลไทย โดยข้อแนะนำเหล่านี้มีข้อผูกพันธ์ทางกฏหมายและรัฐบาลไทยจะต้องนำไปปฏิบัติตามเพื่อพัฒนาสถานการณ์ในประเทศ ในทางเดียวกัน กลุ่มองค์กรภาคประชาสังคม นักปกป้องสิทธิมนุษยชนและนักกิจกรรมก็ต้องร่วมมือกันกดดันรัฐบาลไทยให้ปฏิบัติตามข้อแนะนำเหล่านี้ด้วย!
#VoicesOfThailand 🗣️ มูลนิธิมานุษยะ พร้อมด้วยมูลนิธิยุติธรรมเพื่อสันติภาพ (Justice for Peace Foundation) เครือข่ายภาคประชาสังคมในกระบวนการการทบทวนสถานการณ์สิทธิมนุษยชนไทย (Thai CSOs Coalition for the UPR) และกลุ่ม #ThaiBHRNetwork ได้จัดทำรายงาน Shadow Report แก่คณะกรรการฯ และเข้าร่วมการประชุม CERD Review เพื่อเป็นกระบอกเสียงให้แก่กลุ่มคนชายขอบทุกกลุ่มในประเทศไทยในที่ประชุม ไม่ว่าจะเป็นกลุ่มชาติพันธุ์ กลุ่มผู้ลี้ภัย กลุ่มแรงงานข้ามชาติ หรือ กลุ่มบุคคลไร้สัญชาติ นอกจากนั้น เราได้นำเสนอประเด็นอื่นๆที่ไม่ได้รับความสนใจนักในอดีต เช่น การเลือกปฏิบัติต่อชาวอีสานซึ่งมักจะถูกเหยียดหยามดูถูกไม่ว่าจะเป็นในโลกออนไลน์หรือในสังคมชีวิตประจำวัน ทำให้นี่เป็นครั้งแรกที่ได้มีการพูดถึงประเด็นของพี่น้องชาวอีสานในที่ประชุมของคณะกรรมการฯ หรือ ประเด็นการการเลือกปฏิบัติแบบทับซ้อน (Intersectional Discrimination)ในกลุ่มพนักงานบริการทางเพศ (Sex Workers) กลุ่มผู้มีเชื้อสายแอฟริกันในไทย รวมไปถึงผู้มีความหลากหลายทางเพศ 🏳️🌈 ในกลุ่มชาติพันธุ์และกลุ่มผู้ลี้ภัย

🚨 Thailand is a paradise but only for the 1%! In 2018, Thailand was ranked as the most unequal country in the world where the rich are only getting richer and the poor are getting poorer. At the bottom of this wealth inequality pyramid are the most marginalized groups: the Khon Isaan, indigenous peoples, Malayu Muslims in the Southern Border Provinces, refugees, asylum seekers or migrant workers. Women and LGBTIQ+ persons in any of these groups are often even more disadvantaged and live a struggle within the struggle.
📣 What are we doing about it? On 22-23 November, Thailand goes through its CERD Review - a human rights mechanism that examines how Thailand is fulfilling its obligations concerning the International Convention on the Elimination of Racial Discrimination (ICERD). On this occasion, we are launching our CERD Shadow Report that highlights the most important issues of racial discrimination in Thailand to inform the review and make sure that concerns of grassroots communities are addressed.
✊🏼 Why is the review so important? As a party to ICERD, Thailand has a legally binding obligation to eliminate racial discrimination and respect, protect and promote human rights in line with this treaty. The outcome of the review, so-called concluding observations, will summarize Thailand's progress and provide recommendations on future actions to improve. Thailand has an obligation to implement these recommendations and all of us, civil society organizations, grassroots communities, human rights defenders and activists need to push the Government to make sure it does!
#VoicesOfThailand 🗣️ Manushya Foundation, together with its partners from the Justice for Peace Foundation, the Thai CSOs Coalition for the UPR and #ThaiBHRNetwork have done extensive advocacy work in the CERD Shadow Report as well as meeting the CERD Committee members to ensure that concerns of all marginalized groups in Thailand are addressed in the review. We have lobbied the CERD Committee members with the truth on the ground. We shared with them rights violations faced by indigenous peoples, ethnic groups, Malayu Muslims, refugees, migrants, stateless persons and people facing intersectional discrimination.
We also brought for the very first time issues that have never been addressed in any UN human rights review of Thailand: the Khon Isaan ethnic group who are routinely discriminated against by the mainstream society in everyday life online and offline. No attention has also been paid in the past to persons facing intersectional discrimination such as 🏳️🌈 LGBTIQ+ indigenous and ethnic minority persons, LGBTIQ+ refugees and asylum seekers, sex workers, and people of African-decent! All these communities must be given justice!
