Submitting an Open Letter to the President of the Supreme Court to #SaveNittaya!

ภาคประชาสังคมร่วมกันส่งจดหมายเปิดผนึกเพื่อเรียกร้องให้ศาลยกฟ้องคดีของพี่กบ นิตยา #Saveนิตยา

วันจันทร์ที่ 1 มีนาคมนี้ พี่กบ นิตยา ม่วงกลางร่วมกับทางมูลนิธิมานุษยะและเพื่อนๆจากภาคประชาสังคมหลายท่านรวมถึง กลุ่มทำทางและพี่ต้น นักกิจกรรมด้านสิทธิ LGBTIQ+ และการค้าบริการถูกกฎหมาย ได้รวมตัวกันนำจดหมายเปิดผนึกไปยื่นต่อประธานศาลฎีกา โดยจดหมายเปิดผนึกของเรานั้นได้เรียกร้องให้ศาลฎีกามีคำตัดสินยกฟ้องคดีรุกป่าของพี่กบ นิตยากับชาวบ้านซับหวายที่เหลือ เพราะทุกคนถูกตัดสินว่ากระทำผิดจนต้องติดคุกอย่างไม่เป็นธรรมจากการดำเนินนโยบายทวงคืนผืนป่าผิดๆ

โดยจดหมายรวมไปถึงคำร้องที่เปิดให้มีจำนวนคนมาร่วมลงชื่อถึง 270 รายชื่อ! ซึ่งต้องขอบคุณความช่วยเหลือจากทุกคนจริงๆ ตอนนี้คำร้องก็ยังเปิดให้ลงนามอยู่เช่นเดิมถึงแม้จะส่งจดหมายไปแล้ว ไปลงชื่อได้เลย!

เมื่อมาถึงสำนักงานประธานศาลฎีกา ทางเราได้ยื่นจดหมายพร้อมกับบันทึกของกระทรวงทรัพยาการธรรมชาติและสิ่งแวดล้อมซึ่งมีประกาศออกมาเมื่อวันที่ 14 พฤศจิกายน 2562 (หลังคำพิพากษาของศาลอุทธรณ์) ยืนยันว่าชาวบ้านซับหวาย 14 คนนั้นเป็น ‘ผู้ยากไร้’ และ ‘ไม่เข้าข่ายเป็นนายทุน’ ดังนั้นชาวบ้านจึงควรได้รับความคุ้มครองและไม่ควรได้รับผลกระทบจากการทวงคืนผืนป่าตั้งแต่ต้น! ชาวบ้านไม่ได้ทำลายป่า แต่ทุกคนเป็นผู้ปกป้องผืนป่า การทำไร่มันสำปะหลังของชาวบ้านแท้จริงนั้นเป็นวิธีการช่วยแก้ปัญหาโลกร้อนเสียด้วยซ้ำ

การยื่นจดหมายนั้นก็ผ่านไปอย่างเรียบร้อยโดยทางเจ้าหน้าที่ได้ยืนยันว่าจะนำส่งจดหมายพร้อมกับหลักฐานอื่นๆ ที่ได้รับให้กับประธานศาลโดยเร็วที่สุดเนื่องจากเข้าใจว่าเป็นคดีที่เร่งด่วน เมื่อจบสิ้นกระบวนการเราได้แต่หวังว่าประธานศาลจะได้รับและนำข้อมูลเหล่านี้ไปใช้ในการพิจารณา และตัดสินโดยยึดหลักความเที่ยงธรรม หลักสิทธิมนุษยชนและหลักความเท่าเทียม และตัดสินยกฟ้องคดีในที่สุด

อย่างไรก็ตามเป็นที่น่าเสียดายที่เราไม่ได้รับอนุญาติให้ถ่ายรูปร่วมกับเจ้าหน้าที่เพื้อใช้เป็นหลักฐานในการยืนยันถึงกระบวนการการส่งจดหมายเปิดผนึกในครั้งนี้ โดยยืนยันว่าแค่สแตมป์บนจดหมายก็เพียงพอแล้ว (ดูรูปได้ในโพสเลย) อีกทั้งต่อมาในระหว่างการทำกิจกรรมถ่ายรูปกลุ่มพร้อมโปสเตอร์ #Saveนิตยา กลุ่มตำรวจหลายคนได้พยายามเข้ามาแทรกแซงโดยการซักถามอยู่หลายครั้งว่าเรากำลังทำอะไร และจะเสร็จเมื่อไหร่ ต่อมาไม่นานบริเวณที่เราทำกิจกรรมก็ถูกรายล้อมไปด้วยตำรวจทั้งในและนอกเครื่องแบบจำนวนหลายคน ซึ่งบางคนก็ได้ถ่ายรูปของพวกเราไปด้วย นอกจากนี้หลังจากที่เราถ่ายรูปด้วยกันเสร็จและออกมาจากบริเวณของศาลแล้ว ก็ยังมีเจ้าหน้าที่คอยติดตามเราอยู่ช่วงหนึ่ง การกระทำดังกล่าวเป็นหน้าที่ของตำรวจจริงเหรอ ? ตอนมีคนแจ้งความในคดีที่ร้ายแรงพวกเขาได้ให้ความสนใจขนาดนี้หรือไม่?

ตอนนี้นิตยากำลังเดินทางกลับบ้าน และเหลือเวลาอีกแค่ 2 วันเท่านั้นก่อนจะถึงวันอ่านคำพิพากษาศาลฎีกาที่จังหวัดชัยภูมิ เราหวังเหลือเกินว่าการต่อสู้ทั้งหมดที่ผ่านมาจะไม่สูญเปล่า นิตยาและชาวบ้านซับหวายต้องได้รับความเป็นธรรมและเป็นผู้ชนะในครั้งนี้ และเราเชื่อว่าในวันที่ 3 มีนาคมที่จะถึงนี้ ศาลจะยกฟ้องคดีของนิตยา และปล่อยให้เธอได้เดินออกจากศาลในฐานะผู้บริสุทธิ์ และในฐานะประชาชนผู้มีสิทธิที่จะดำรงชีวิตและใช้ประโยชน์ในที่ดินของตน

ร่วมช่วยกันจับตามองคดีนี้และให้กำลังใจนิตยา ตอนนี้ยังมีเวลาพอที่จะลงชื่อในคำร้องเพื่อให้ศาลยกฟ้องคดี! เสียงของคุณมีความหมายและมีพลังพอที่ศาลจะต้องฟัง!

Yesterday, March 1, 2021, Nittaya Muangklang, Manushya Foundation, along with our supportive friends from several CSOs including Tamtang and Sirisak Chaited gathered together to submit an open letter to the President of the Supreme Court. Our open letter demands the Supreme Court to dismiss Nittaya’s and the rest of the Sab Wai villagers cases as they were unfairly convicted from the bad implementation of the Forest Reclamation Policy!

Our letter and petition in support of Nittaya and Sab Wai villagers have gathered over 270 signatures thanks to all of your support! The petition is still open for signature online, until all Sab Wai villagers will be given justice!

We went to the Office of the President of the Supreme Court to submit the letter and give the President the Memorandum issued by the Ministry of Natural Resources and Environment, on 14 November 2019 (after the Appeal Court hearings), recognizing the 14 Sab Wai Villagers as ‘impoverished’ and ‘non-capitalist investors’ who should not be evicted by the Forest Reclamation Policy, as they are not destroying the forest. The Sab Wai villagers are actually PROTECTORS of the forest, thanks to their cassava farming practices; Cassava being known to be an excellent climate change adaptation solution!

The submission procedure went well. The officer promised to forward our letter along with all the supporting documents to the President as soon as possible as Nittaya’s case is very urgent. As of now, we can only hope that the Supreme Court and its President will take our letter and evidence into consideration and uphold justice and human rights and equality by dismissing the cases.

Sadly, none of the officers agreed to take a picture with us to confirm the submission process, claiming that the stamp of the Supreme Court shall suffice (you can see it in the pictures)! We also encountered an obstacle afterward when we tried to take group pictures with #SaveNittaya posters for our campaign. A group of police officers had approached us to ask what we were doing and how long we would be there. The police and plainclothes policemen started to gather around us with more police coming along with the police car. Some even took several pictures of us! They even followed us after we finished taking pictures and video. Is this really the police’s duty? Why do they suddenly care so much when they rarely pay attention when people try to report the actual crime to them?

Now Nittaya went back home to Chaiyaphum with only one more day left until her Supreme Court verdict will be delivered on March 3rd, 2021, at Chaiyaphum Provincial Court. We hope with all our hearts that our joint efforts will bring justice to Nittaya and the Sab Wai villager’s cases! We hope that on this upcoming March 3rd, Nittaya’s case will be dismissed and she will get to walk out FREE with the right to live and earn her livelihood on her own land.
