Every year on 10 December, the world celebrates Human Rights Day, and Thailand commemorates the adoption of its first Constitution, which transformed the country from an absolute monarchy into a constitutional monarchy.

#ConstitutionDay 🗓🔓 Worryingly, after 90 years and 20 different constitutions, true democracy still has not been realized in Thailand. Instead, the rights of people who stand up for equality, freedom, and a more democratic constitution are often violated.

Let’s take a look at notable instances in the past year where the Thai justice system has failed to protect the rights of its citizens as laid down in the Constitution ⤵️

🚫 After 2 years, 6 protests leaders are indicted on a sedition charge for staging a demonstration at Thammasat University in August 2020, including Arnon Nampa who called for the drafting of a new constitution.

🚫 Bung and Baipor, two pro-democracy women activists, were denied bail 7 times and detained for 94 days after being charged with lèse-majesté. The imprisonment clearly disregarded their constitutionally protected right to be granted bail and presumed innocent.

🚫 The Constitutional Court determined in September that Prime Minister Prayut Chan-o-cha, who seized power through a coup in 2014, could remain in his seat until 2025, or more than 10 years. Despite the constitution only allowing a PM to serve for 8 years, the Court ruled that his tenure started in 2017, when the new Constitution was promulgated.

🚫 The Constitutional Court ruled that calls for royal reform represented an attempt to overthrow the monarchy.

💡 Nonetheless, there has recently been a step towards a hopeful future. In November, the parliament supported the motion to hold a referendum to pave the way for a constitution rewrite. If the senate gives a green light and the people vote in favor of a new constitution, Thailand may have a chance at being protected by a constitution that is not written by the authoritarian military junta.

✊ Manushya Foundation stands firm in our support for the pro-democracy movement’s calls for a people-centered constitution and TRUE democracy. We urge that the Thai government respect the people’s right to freedom of speech, the right to bail, the right to vote, along with many others, which are not only safeguarded in the Thai constitution, but also in the Universal Declaration of Human Rights. The government must also comply with the UPR recommendations on #FreedomOfExpression and #FreedomOfAssembly, which it received during the 3rd UPR cycle.

ทุกวันที่ 10 ธันวาคมของทุกปีเป็นวันสิทธิมนุษยชนสากล และวันรัฐธรรมนูญของไทย หรือวันที่ประเทศไทยประกาศใช้รัฐธรรมนูญฉบับแรก ซึ่งเปลี่ยนแปลงระบบการปกครองของประเทศจากสมบูรณาญาสิทธิราชย์เป็นระบอบประชาธิปไตยอันมีพระมหากษัตริย์ทรงเป็นประมุข

#วันรัฐธรรมนูญไทย 🗓🔓 อย่างไรก็ดี 90 ปีผ่านไป ประชาธิปไตยที่แท้จริงก็ยังไม่เกิดขึ้นในประเทศไทย มิหนำซ้ำ ผู้ที่ออกมาเรียกร้องความเท่าเทียม เสรีภาพ และรัฐธรรมนูญที่เป็นธรรมและมีความเป็นประชาธิปไตยกลับถูกละเมิดสิทธิขั้นพื้นฐานอยู่บ่อยครั้ง

นี่คือตัวอย่างของเหตุการณ์การละเมิดสิทธิที่สำคัญในปีที่ผ่านมา อันเป็นผลมาจากกระบวนการยุติธรรมของไทยที่ล้มเหลวและไม่สามารถคุ้มครองสิทธิของพลเมืองไทยตามที่บัญญัติไว้ในรัฐธรรมนูญได้ ⤵️

🚫 สองปีผ่านไป แกนนำผู้ชุมนุม 6 คนถูกอัยการสั่งฟ้องในข้อหายุยงปลุกปั่นจากการจัดชุมนุมในมหาวิทยาลัยธรรมศาสตร์เมื่อเดือนสิงหาคม 2563 ซึ่ง 1 ใน 6 คนนี้คืออานนท์ นำภาที่เรียกร้องให้มีการร่างรัฐธรรมนูญใหม่ด้วย

🚫 หลังถูกดำเนินคดีม.112 บุ้ง และใบปอ สองนักเคลื่อนไหวเพื่อประชาธิปไตยจากกลุ่มทะลุวังถูกปฏิเสธไม่ให้ประกันตัวถึง 7 ครั้ง และถูกคุมขัง 94 วัน ซึ่งนับเป็นการกักขังที่ละเลยสิทธิการประกันตัวและการสันนิษฐานว่าบริสุทธิ์ตามรัฐธรรมนูญไทย

🚫 เมื่อเดือนกันยายน ศาลรัฐธรรมนูญตัดสินให้ พล.อ.ประยุทธ์ จันทร์โอชา นายกรัฐมนตรีสามารถดำรงตำแหน่งต่อไปได้จนถึงปี 2568 แม้ประยุทธ์จะเข้ายึดอำนาจด้วยการรัฐประหารตั้งแต่ 2557 ซึ่งจะทำให้เขาสามารถเป็นนายกได้เกิน 10 ปี โดยศาลให้เหตุผลว่าการดำรงตำแหน่งของเขาเริ่มในปี 2560 ตอนที่มีการประกาศใช้รัฐธรรมนูญฉบับใหม่

🚫 ศาลรัฐธรรมนูญตัดสินว่าการเรียกร้องให้มีการปฏิรูปสถาบันกษัตริย์เท่ากับเป็นความพยายามล้มล้างระบอบการปกครอง

💡 อย่างไรก็ตาม ไม่นานมานี้มีความคืบหน้าที่ยังทำให้เราพอมีหวัง เนื่องจากเมื่อเดือนพฤศจิกายน ส.ส. โหวตเห็นด้วยกับการทำประชามติเพื่อปูทางไปสู่การเขียนรัฐธรรมนูญใหม่ หากวุฒิสภาไฟเขียวและประชาชนลงมติว่าต้องการร่างรัฐธรรมนูญใหม่ และประเทศไทยอาจมีโอกาสได้อยู่ภายใต้รัฐธรรมนูญที่ไม่ได้ถูกเขียนโดยเผด็จการทหาร

✊ มูลนิธิมานุษยะขอยืนหยัดสนับสนุนการเรียกร้องรัฐธรรมนูญใหม่ของขบวนการประชาธิปไตย เพื่อให้ไทยได้มีรัฐธรรมนูญที่ประชาชนเป็นศูนย์กลางและเป็นประชาธิปไตยที่แท้จริง เราเรียกร้องให้รัฐบาลไทยเคารพในสิทธิเสรีภาพในการแสดงออกของประชาชน สิทธิในการประกันตัว สิทธิในการเลือกตั้ง และสิทธิพื้นฐานอื่นๆ ซึ่งไม่เพียงแต่เป็นสิทธิที่ได้รับการคุ้มครองในรัฐธรรมนูญไทยเท่านั้น แต่ระบุในปฏิญญาสากลว่าด้วยสิทธิมนุษยชน นอกจากนี้ รัฐบาลยังต้องปฏิบัติตามคำแนะนำจาก UPR ครั้งที่ 3 เรื่อง #เสรีภาพในการแสดงออก และ #เสรีภาพในการชุมนุม ด้วย
