(English below) #PoliceBrutality 🚓 ยุติธรรมที่ล่าช้าก็คืออยุติธรรม คดีตำรวจซ้อมทรมานผู้ชุมนุมยังไม่มีความคืบหน้า


❌ ผ่านไปได้สองเดือนแล้ว ตั้งแต่อรรถสิทธิ์ นุสสะ และวีรภาพ วงษ์สมาน ได้แจ้งความกับ สน.ดินแดง พวกเขาโดนเจ้าหน้าที่ตำรวจซ้อมทรมานระหว่างถูกควบคุมตัวเมื่อวันที่ 29 ต.ค. 2564 และช่างตลกร้ายเหลือเกินที่วันนั้นพวกเขาอยู่ที่งานไว้อาลัยวาฤทธิ์ สมน้อย เยาวชนอายุ 15 ปี ที่ถูกยิง (และเสียชีวิตในเวลาต่อมา) หน้า สน.ดินแดง เมื่อวันที่ 16 ส.ค. หลังจากการเข้าร่วมการประท้วงบริเวณดินแดง


🤬 "พี่ขอละกัน พี่อยากได้คนนี้" ตำรวจชั้นหัวหน้ากล่าวก่อนเริ่มซ้อมทรมานอรรถสิทธิ์ นุสสะ โดยกล่าวหาว่าเขาเผาศาลพระภูมิและมีส่วนเกี่ยวข้องกับผู้ที่ต้องสงสัยว่ายิง คฝ. เมื่อคืนวันที่ 6 ต.ค. เจ้าหน้าที่ตำรวจยังได้ขู่อีกว่าหากเขาเสียชีวิตระหว่างการซ้อมทรมาน ก็จะทำให้ดูเหมือนเป็นอุบัติเหตุ


🩹 "ก็ซ้อมอยู่นั่นแหละ ซ้อมหลายที ทั้งเตะ ทั้งต่อย เอาหัวกระแทกกับเก้าอี้ไม้ เขาก็เอากระบองมากระแทกตรงซี่โครงด้านขวา จากนั้นเขาก็มาเค้นเอารหัสโทรศัพท์ว่ารหัสอะไร เขาจะเข้าไปดูว่าเกี่ยวข้องกับทะลุแก๊ซไหม ผมก็ให้รหัส ผมก็ให้ผิดเพราะจำไม่ได้ เขาก็บีบคอจนเกือบสลบเลย" อรรถสิทธิ์เล่า


🚬 ในวันเดียวกันนั้นเอง อาลีฟ-วีรภาพ วงษ์สมาน เยาวชนอายุ 18 ปี กล่าวว่าเขาถูกนำตัวไปห้องขังเดี่ยวแล้วบังคับให้ถอดกางเกง จากนั้นเจ้าหน้าที่สืบสวนก็กระทืบบริเวณอวัยวะเพศและนำบุหรี่มาจี้ตามตัวเขา ระหว่างการควบคุมตัวนาน 9 ชั่วโมง เขายังโดนขู่อีกว่า "พวกมึงทำขนาดนี้ กูไม่เอาไปยิงทิ้งน้ำก็บุญแค่ไหนแล้ว"


➡️ แม้จะทำเรื่องขอไปหลายหน ตำรวจยังคงไม่ได้มอบภาพจากกล้องวงจรปิดและผลตรวจร่างกายให้กับอรรถสิทธิ์ เจ้าหน้าที่ที่ซ้อมทรมานเขายังคงทำงานตามปกติ ยังไม่มีการดำเนินการสืบสวนภายในแต่อย่างใด ด้านวีรภาพขอเลื่อนนัดให้การไปเป็นวันที่ 21 ม.ค. เนื่องจากติดธุระส่วนตัว


🚩 แทนที่จะตรวจสอบอาชญากรรมที่คนในสังกัดก่อ พ.ต.ท.โสภณ แย้มชมชื่น รอง ผกก. สน.ดินแดง กลับโทษความรุนแรงของตำรวจ (police brutality) กับผู้ประท้วง โดยอ้างว่าหากการชุมนุมเป็นไปอย่างสงบก็จะไม่มีเหตุรุนแรงเกิดขึ้น ทั้ง ๆ ที่ผู้ชุมนุมเพียงแสดงออกทางสัญลักษณ์กับศาลพระภูมิและจุดเทียนไว้อาลัยเท่านั้น มีเพียงเจ้าหน้าที่ตำรวจที่ทำร้ายร่างกายประชาชน


📃 การซ้อมทรมานโดยตำรวจเป็นปัญหาของไทยมาเป็นเวลานาน รัฐบาลไม่ยอมแก้ไขอย่างจริงจังเสียที #พรบอุ้มหาย ฉบับล่าสุดก็ไม่ได้มาตรฐานสิทธิมนุษยชนสากล ไทยมีพันธะกับอนุสัญญาต่อต้านการทรมานและการประติบัติหรือการลงโทษอื่นที่โหดร้าย ไร้มนุษยธรรม หรือที่ย่ำยีศักดิ์ศรี (CAT) ที่กำหนดว่ารัฐบาลจะต้อง "ประกันว่าการกระทําทรมานทั้งปวงเป็นความผิดตามกฎหมายอาญา" โดย "มีระวางโทษที่เหมาะสมกับความร้ายแรง"


⚖️ มูลนิธิมานุษยะประณามความรุนแรงโดยรัฐทุกประเภท และเรียกร้องให้มีการสืบสวนเหตุการณ์ข้างต้นอย่างละเอียด ยุติธรรมต้องถึงมือประชาชน! ยุติความรุนแรงโดยตำรวจ!

#PoliceBrutality 🚓 Justice DELAYED is justice DENIED. The beating of protestors is yet to be investigated.


❌ Two months have gone by since Auttasit Nussa and Weeraphab Wongsaman filed a complaint against police at the Din Daeng Police Station. They were beaten while in custody on October 29, 2021. The irony was that the two were attending a candle vigil held for Warit Somnoi, a 15-year-old shot (and later died) in front of Din Daeng police station on August 16 after attending a protest near Din Daeng. Little progress has been made in all these cases.


🤬 "Let me have him. I want this one," said a senior police officer before he started beating Auttasit Nussa, accusing him of burning a shrine and being related to the man who shot the policeman on the evening of 6 October. The police reportedly told him that if he died during the beating, they would make his death look like an accident.


🩹 "They beat me a lot. They kicked me. They punched me. They smacked my head into a wooden chair. They use a baton to hit the ribs on my right side. Then, they choked me to get my phone password. They wanted to find out if I was involved with Thaluhgaz. I told them but it was wrong. I couldn’t remember. They squeezed my neck so hard that I almost fainted," Auttasit recalled.


🚬 On the same day, 18-year-old Weeraphab "Leaf" Wongsaman said he was taken to a solitary room and stripped down to his pants. Interrogators then stomped on his genitals and stubbed out cigarettes on his lower stomach. During the 9-hour-long detention, he was also told, "After all you've done, you're lucky I don't shoot you dead."


➡️ Despite repeated requests, police have neither provided Auttasit with CCTV footage nor the results of the medical exam he was given before being released. The officers he accuses of beating him remain on duty and there is no indication of an internal disciplinary investigation committee. Meanwhile, Weeraphab’s testimony has been postponed until January 21 due to his own inconvenience.


🚩 Instead of investigating his officers' crimes, the Din Daeng Police Station deputy superintendent Pol Lt Col Sophon Yaemchomcheun blamed protestors for police brutality, saying "You have to look at that point too. They ran to us too…If the gathering was really peaceful, nothing would happen. But you come and use violence, burning, speaking aggressively."


📃 Torture in police custody is a long-standing problem in Thailand. The government has failed again and again to fix it. Their recent Prevention and Suppression of Torture and Enforced Disappearance Bill does not meet international human rights standards. Thailand is a party to the UN Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment and according to its Article 4, has obligations to "ensure that all acts of torture are offenses under its criminal law" and "make these offenses punishable by appropriate penalties."


⚖️ Manushya Foundation condemns state violence of any kind and calls for a thorough investigation into these incidents. Justice must be served! END POLICE BRUTALITY.
