RSAT withdrew from suing Sirisak Chaited, an attempt to save face?







(English Below) ✨สมาคมสีรุ้งแห่งประเทศไทยถอยแล้ว! หลังทนแรงกดดันไม่ไหวจนต้องถอนฟ้องศิริศักดิ์ ไชยเทศในที่สุด!


🏳️‍🌈สมาคมสีรุ้งแห่งประเทศไทยแถลงข่าวยุติการดำเนินคดีต่อศิริศักดิ์ ไชยเทศหลังไม่อาจทนแรงกดดันจากกลุ่มนักปกป้องสิทธิมนุษยชนทั้งไทยและต่างประเทศมากกว่า 400 องค์กร


📍สมาคมสีรุ้งแห่งประเทศไทยตัดสินใจที่จะไม่ฟ้องนักปกป้องสิทธิ LGBTIQ+ ศิริศักดิ์ ไชยเทศจากกรณีคืนรางวัลอรรธนารีศวรที่ได้รับมาเมื่อปี 2562 สมาคมกล่าวว่าการที่คุณกิตตินันท์ ธรรมธัช นายกสมาคมเจ้าร่วมเวทีเสวนา ห้วข้อ “LGBT+ ไม่ใช่คนหยาบคาบ พฤติกรรมม็อบบดบังเสรีภาพทางเพศ” จัดโดย พรรคการเมืองที่มีแนวคิดกษัตริย์นิยมอย่าง พรรคไทยภักดี เมื่อวันที่ 8 ธันวาคม 2564 ทำให้เกิดกระแสต่อต้านจากผู้ที่มองว่า วงเสวนาดังกล่าวผลิตซ้ำความเกลียดชังและอคติต่อนักเคลื่อนไหวประชาธิปไตย LGBTQ+ ซึ่งศิริศักดิ์เองก็เข้าร่วมด้วย


➡️การถอนฟ้องครั้งนี้อาจถูกมองว่าเป็นการตัดสินใจที่ช้าเกินไปและเป็นไปเพื่อรักษาหน้า หลังเกิดผลกระทบเป็นลูกโซ่ เนื่องจากผลกระทบจากเหตุการณ์ดังกล่าวทำให้นักกิจกรรมสิทธิความหลากหลายทางเพศลาออกจากการเป็นคณะกรรมการจัดทำร่างกฎหมายรับรองอัตลักษณ์ทางเพศสภาพ การแสดงทางเพศสภาพ และคุณลักษณะทางเพศ : GEN-ACT ซึ่งคุณแดนนี่ นายกสมาคมฟ้าสีรุ้ง ร่วมเป็นคณะกรรมการด้วย


➡️นอกจากนี้ยังมีการรวบรวมรายชื่อจาก 360 คนและ 73 องค์กรโดยเครือข่ายภาคีองค์กรด้านสิทธิทางเพศและนักเคลื่อนไหวสตรีนิยม (The Feminist Liberation Front Thailand) เพื่อสนับสนุนศิริศักดิ์ คำแถลงการณ์ย้ำเตือนว่าศิริศักดิ์มีสิทธิ์ที่จะวิพากษ์วิจารณ์โดยสุจริต และกล่าวว่าการกระทำของสมาคมฯ นั้นเห็นได้ชัดว่ามีลักษณะเป็นการฟ้องเพื่อ “ปิดปาก”


✊ศิรศักดิ์กล่าวว่าได้รับการสนับสนุนอย่างเต็มที่จากหลากหลายองค์กร อาทิ มูลนิธิมนุษยะ (Manushya Foundation), เครือข่ายภาคีองค์กรด้านสิทธิทางเพศและนักเคลื่อนไหวสตรีนิยม (The Feminist Liberation Front Thailand) มูลนิธิเพื่อพนักงานบริการ (Swing Foundation), กลุ่ม Young Pride Club และ มูลนิธิเอ็มพาวเวอร์ Empower Foundation

🌈 เราจะยืนหยัดที่จะพูดความจริงต่อผู้มีอำนาจและสนับสนุนการต่อสู้เพื่อประชาธิปไตยที่แท้จริง ผู้มีความหลากหลายทางเพศจะยังไม่ได้รับสิทธิที่ควรจะได้หากยังสนับสนุนอุดมการณ์ของพรรคไทยภักดีและรัฐบาลทหารดังเช่นการกระทำของนายกสมาคม ความเท่าเทียมทางเพศและสิทธิมนุษยชนไม่อาจเกิดขึ้นได้ถ้าปราศจากประชาธิปไตย เพราะสิทธิมนุษยชนเป็นสิ่งสากลและเป็นของทุกคน

✨RSAT withdrew from suing Sirisak Chaited, an attempt to save face?

🏳️‍🌈RSAT withdrew from suing Sirisak Chaited only after pressure from more than 400 local and regional human rights groups and individuals!


📍 RSAT (Rainbow Sky Association of Thailand) decided not to press charges against LGBTIQ+ activist Sirisak Chaited for returning his 2018 Ardhanarishvara Award. RSAT said that other comments against protesters were beyond its control when its President joined a royalist panel on 8 December 2021. Indeed, the president of RSAT appeared on and showed support for a panel on "LGBTIQ+ people aren't rude: How behaviors in protests overshadow the issue of gender equality" organized by the royalist Thai Pakdee party. The panel perpetuated hate and prejudice towards LGBTIQ+ pro-democracy activists and the protests Sirisak had personally joined, he pointed out.


➡️ The withdrawal may come a little too late and be seen as a way not to lose face, as the domino effect is still having its impacts: LGBTI activists resigned from the Committee on Draft Legal Recognition Law on Gender Identity, Gender Expression and Sex Characteristic, a working group coordinated by Kittinan "Danny" Daramadhaj, the President of RSAT.


➡️Moreover, signatures from 360 individuals and 73 organizations expressing support for Sirisak were collected by the Feminist Liberation Front Thailand. The statement reaffirmed Sirasak’s right to criticize in good faith, and called the Association’s move an example of a "SLAPP" (Strategic Lawsuit Against Public Participation).


✊ Sirisak said he received great support from organizations such as Manushya Foundation, the Feminist Liberation Front Thailand, Swing Foundation, Pride Club, and Empower Foundation.

🌈 We will continue to speak Truth to power and support the fight for true democracy! The LGBTIQ+ rights cannot be realized while supporting the ideology of the Thai Pakdee party and the military regime, as RSAT's President did. Gender equality and Human Rights can never be fully achieved without democracy. Human Rights are UNIVERSAL!
