🚫 Say NO to NPO law! Civil society is not an “enemy” of the State!








(EN Below) ✊🏼เมื่อวานนี้ เครือข่ายภาคประชาสังคม 19 กลุ่มร่วมคัดค้านร่างแก้ไขฉบับล่าสุดของกฏหมายควบคุมองค์กรภาคประชาสังคม หรือ พ.ร.บ. เอ็นจีโอ ซึ่งผ่านการเห็นชอบของคณะรัฐมนตรี โดยอ้าง “ประโยชน์สาธารณะ” เป็นเหตุผลในการควบคุมภาคประชาสังคม ทั้งๆที่การทำงานขององค์กรเหล่านี้ล้วนเป็นไปเพื่อประโยชน์สาธารณะและประชาธิปไตยของประเทศ โดยเป็นเเรงผลักดันในการพัฒนาเเละเเก้ปัญหาในเเบบที่รัฐบาลทำไม่ได้มากว่า 20 ปี!!!


📍 เเต่…รัฐบาลกลับตอบเเทนการทำงานเพื่อสาธารณะขององค์กรประชาสังคมเหล่านี้ด้วยมาตรการที่กดขี่และควบคุมเกินจะเป็น 3 อย่าง ได้แก่

  1. การขึ้นทะเบียนที่มีความซ้ำซ้อนเเละไม่ชัดเจน

  2. การให้อำนาจ “เจ้าหน้าที่รัฐ” เเทนที่จะเป็น “ศาล” ในการตัดสินลงโทษองค์กรภาคประชาสังคม ซึ่งเป็นการขัดหลักนิติธรรมอย่างชัดเจน

  3. การควบคุมเเหล่งรายได้โดยอ้างการฟอกเงินเเละการก่อการร้าย

🇹🇭 การกระทำดังกล่าวของรัฐบาลขัดต่อทั้งหลักการประชาธิปไตยเเละสิทธิมนุษยชน โดยเฉพาะสิทธิในการรวมกลุ่ม (Right to Freedom of Association) ตามมาตราที่ 22 ของอนุสัญญาว่าด้วยสิทธิพลเมืองและสิทธิทางการเมือง (ICCPR) ที่ประเทศไทยเข้าเป็นภาคีตั้งเเต่ปีพ.ศ. 2539


💓 ดังนั้นทางมูลนิธิมานุษยะจึงขอร่วมยืนเคียงข้างและต่อสู้ไปกับเครือข่ายองค์กรภาคประชาสังคมในการยับยั้งการออกกฎหมายที่กดขี่สิทธิเสรีภาพของประชาชนเช่นนี้ รัฐบาลพลเอก ประยุทธ์ จันทร์โอชาต้อง “หยุด” ที่จะใช้กฎหมายเพื่อสร้างความชอบธรรมในการจัดการผู้เห็นต่าง และต้องปฏิบัติตามพันธะกรณีที่ไทยมีต่อกฏหมายสิทธิมนุษยชนระหว่างประเทศอย่างหลักนิติธรรมด้วย!

✊🏼 A Network of 19 civil society organizations gathered yesterday to oppose the parliament’s approval of the recent changes made to the Law on the Operations of the Not-For-Profit Organizations (NPO Law 2021). Despite the fact that civil society groups have worked for the public for more than 20 years, the so-called “public interest” is hilariously weaponized by the government to rationalize their attempts to silence their citizens calling for true democracy in the country.


📍 Despite its selfless contribution for the greater good of Thailand, the Thai government has, in turn, repaid the civil society sector by incorporating 3 restrictive and controversial measures into the draft, which are:

  1. A complicated and unclear registration system

  2. Authorizing state officials instead of the courts to impose penalties on civil society organizations. This is undeniably against the rule of law.

  3. Controlling the source of funding with excuses like money laundering and terrorism!

🇹🇭 The draft NPO Law explicitly violates the democratic principle of a free society and human rights, especially the right to freedom of association as guaranteed in Article 22 of the International Covenant on Civil and Political Rights (ICCPR), to which Thailand has been a State Party since 1996.


💓 Manushya Foundation stands in solidarity with and joins all civil society groups working to oppose the adoption of this repressive law. The government should stop its attempt to ‘rule by law’, and instead live up to its obligations before international human rights standards and the sacrosanct principle of the ‘rule of law’.
