#LGBTQ 🤬 นักเคลื่อนไหวไม่นิ่งดูดายต่อความเห็นต่อต้านม็อบ! เมื่อวันที่ 9 ม.ค. ศิริศักดิ์ ไชยเทศ นักกิจกรรมเพื่อประชาธิปไตยและความเท่าเทียมหลากหลายทางเพศ และสมาชิกคณะกรรมการมูลนิธิมานุษยะ ประกาศคืนรางวัลปี 2562 แก่สมาคมฟ้าสีรุ้ง หลัง แดนนี่-กิตตินันท์ ธรมธัช นายกสมาคม เข้าร่วมอภิปรายในเวทีเสวนาของพรรคไทยภักดี ในหัวข้อ "LGBTQ+ ไม่ใช่คนหยาบคาย พฤติกรรมม็อบบดบังเสรีทางเพศ" รวมถึงแสดงความเห็นด้วยกับสารของงานดังกล่าว ศิริศักดิ์มองว่าการเข้าร่วมเวทีเสวนานี้ถือเป็นการเข้าข้างรัฐประหารและระบอบเผด็จการ เนื่องจากหัวหน้าพรรคไทยภักดีมีท่าทีชัดเจนว่าเขาสนับสนุนให้ประยุทธ์ จันทร์โอชาเป็นนายกรัฐมนตรี การกระทำนี้แสดงให้เห็นว่าสมาคมฟ้าสีรุ้งมีจุดยืนสนับสนุนการละเมิดสิทธิมนุษยชน ซึ่งเป็นสิ่งที่ศิริศักดิ์ไม่อาจยอมรับได้
🏆 ศิริศักดิ์ได้รับรางวัลอรรธนารีศวร ด้านส่งเสริมสิทธิมนุษยชนในกลุ่มประชากรที่มีความหลากหลายทางเพศ ประเภทบุคคล จากงานเคลื่อนไหวที่เขาถือว่าเป็นส่วนหนึ่งของการต่อสู้เพื่อประชาธิปไตยในปัจจุบัน เขาให้เหตุผลการคืนรางวัลข้างต้นว่า เวทีเสวนาของพรรคไทยภักดีผลิตซ้ำความเกลียดชังและการเหมารวมต่อการประท้วงเพื่อประชาธิปไตยที่เขามีส่วนร่วม ยิ่งไปกว่านั้น ยังมีเจ้าหน้าที่ฝ่ายสิทธิมนุษยชนของสมาคมฟ้าสีรุ้งท่านหนึ่งที่ถือป้ายภายในงาน ความว่า "ม็อบกักขฬะ จะทำร้าย LGBT+ ส่วนใหญ่"
#SLAPP 🚩 เรื่องที่น่าตกใจคือกิตตินันท์ ธรมธัช ได้โพสต์ข้อความในเฟซบุ๊กส่วนตัว ขู่จะฟ้องผู้ใดก็ตามที่ 'ดูหมิ่นสมาคมและบุคคล' ในขณะเดียวกัน สมาคมฟ้าสีรุ้งได้ออกแถลงการณ์ยืนยันความมุ่งมั่นด้านสิทธิมนุษยชนอีกครั้งและอ้างว่าพวกเขาไม่ใช่องค์กรทางการเมือง ช่างเป็นความพยายามในการรักษาหน้าที่น่าเวทนา!

🏳️🌈 อย่าลืม : เมื่อ พ.ย. ปีที่แล้ว เวที UPR ครั้งที่ 3 ประเทศไทยได้รับ 12 ข้อแนะนำเกี่ยวกับสิทธิของผู้มีความหลากหลายทางเพศ ซึ่งจำนวน 4 ข้อ แนะนำให้แก้ไขมาตรา 1448 แห่งประมวลกฎหมายแพ่งและพาณิชย์ เพื่อรับรองสมรสเท่าเทียม นอกจากนี้ สนธิสัญญาด้านสิทธิมนุษยชนของ UN หลายฉบับที่ไทยได้ลงนามไว้ ไม่ว่าจะเป็นกติการะหว่างประเทศว่าด้วยสิทธิและเมืองและสิทธิทางการเมือง (ICCPR) กติการะหว่างประเทศว่าด้วยสิทธิทางเศรษฐกิจ สังคม และวัฒนธรรม (ICESCR) และอนุสัญญาว่าด้วยการขจัดการเลือกปฏิบัติต่อสตรีในทุกรูปแบบ (CEDAW) ก็มีผลผูกพันทางกฎหมายให้รัฐบาลรับผิดชอบสิทธิมนุษยชนของผู้มีความหลากหลายทางเพศ ประเทศไทยและสมาคมฟ้าสีรุ้งจำเป็นต้องแสดงความรับผิดชอบต่อข้อตกลงนานาชาติเหล่านี้

✊ Manushya Foundation stands in solidarity with LGBTIQ+ pro-democracy activists and our Board Member Sirisak Chaited. Speaking truth to power is not a crime! Protecting the dignity of LGBTIQ+ pro-democracy protesters being undermined during a Royalist panel is NOT A CRIME! Calling RSAT's president to respect the universality of human rights and comply with international human rights is not defamation = it is simply standing up for our fundamental human rights and dignity!
🏳️🌈 #LGBTIQ+ 🤬 Comments against pro-democracy protests were not tolerated! Sirisak Chaited, a prominent pro-democracy and LGBTQIAN+ activist, also a Board Member of Manushya Foundation, announced on January 9 that he was returning his 2018 award to the Rainbow Sky Association of Thailand (RSAT).
🚨 The move came after Kittinun "Danny" Daramadhaj, President of the association, appeared on and showed support for a panel on "LGBTQ+ people aren't rude: How behaviors in protests overshadow the issue of gender equality" The panel was organized by the royalist Thai Pakdee party whose party's leader has been clear about his support for Prayuth Chan-o-cha as PM.
🏆 Sirisak pointed out that the activities he received the 2018 award for go hand in hand with the current pro-democracy movement. He explained that the panel perpetuated hate and prejudice towards protests he has personally joined. One of RSAT members also held a placard read "Barbaric protests hurt the majority of LGBT+ people."
#SLAPP 🚩 In a shocking development, on January 13, Kittinan "Danny" Daramadhaj published a statement on his Facebook account threatening to sue anyone who 'defamed against the organization and individuals' with defamation carrying a minimum charge of 40 million THB and imprisonment. In the meantime, RSAT issued a statement re-explaining the purpose of their human rights award & claiming they are not a political organization - a sad attempt to save their face!
👏 Manushya Foundation applauds Sirisak Chaited and anyone else who speaks Truth to power for their bravery and condemns RSAT's hypocritical stance on human rights! Threatening with a lawsuit for exercising the right to freedom of expression means downgrading oneself to the level of Prayut's Government scared of hearing the truth! Gender equality can never be fully achieved without democracy. Organizations that claim to support LGBTQIAN+ rights have a responsibility to also advocate for freedom of expression and equality in all aspects! Human Rights are UNIVERSAL.
🏳️🌈 As a reminder, during Thailand's 3rd UPR review in November 2021, the government received 12 recommendations on LGBTQIAN+ rights, including 4 to amend Section 1448 of the Civil and Commercial Code in order to recognize marriage equality. Moreover, several UN human rights treaties ratified by Thailand, including the International Covenant on Civil & Political Rights, the International Covenant on Economic, Social and Cultural Rights, the Convention on the Elimination of All Forms of Discrimination against Women among others, guarantee the government's obligations regarding the human rights of LGBTQIAN+ people. Thailand and RSAT must comply with international human rights obligations and commitments.
