#StopDigitalDictatorship R.A.D. song banned after the Court found it a threat to 'National Security'
🛑 เพลง 'ปฏิรูป' ของ Rap Against Dictatorship ถูกศาลสั่งห้ามเผยแพร่ เหตุกระทบต่อความมั่นคงของรัฐ
เมื่อวันที่ 7 กรกฎาคม 2565 ศาลอาญาได้ออกคำสั่งระงับวิดีโอเพลง #ปฏิรูป ของแรปเปอร์การเมือง Rap Against Dictatorship (R.A.D.) เนื่องจากกระทรวงดิจิทัลฯได้ร้องเรียนว่าเนื้อเพลง #ปฏิรูป มีถ้อยคำหยาบคายมีข้อความที่พาดพิงไปถึงสถาบันและกระทบต่อความมั่นคงของรัฐ ซึ่งมีความผิดตามพ.ร.บ. คอมพิวเตอร์
ประเด็นหลักของเนื้อเพลง #ปฏิรูป นั้นเพียงมุ่งสะท้อนถึงการวิจารณ์การทำงานของรัฐบาล พล.อ. ประยุทธ์ จันทร์โอชา และการใช้ความรุนแรงของเจ้าหน้าที่รัฐต่อประชาชน เช่นนี้การสะท้อนถึงสถานการณ์ที่เกิดขึ้นจริงภายในประเทศไทยจะถือเป็นภัยต่อความมั่นคงได้อย่างไร? ดังนั้นการที่ศาลออกคำสั่งระงับการเผยแพร่เนื้อเพลงเช่นนี้จะถือว่าไม่เป็นธรรม เพราะแม้แต่ตัวแทนจากกระทรวงดิจิทัลฯยังไม่สามารถระบุได้ว่าเนื้อเพลง #ปฏิรูป ได้มีการพาดพิงถึงสถาบันหรือไม่

#StopDigitalDictatorship 🛑 R.A.D. rap song was banned again after the court found it a threat to 'national security' and filled with vulgar language.
On July 7, the Criminal Court banned the 'Patiroob' MV song after the Ministry of Digital Economy and Society filed a request to suspend the dissemination of the music video for violating the Computer Crime Act and threatening national security.
The ruling is very concerning. The Court, once again, failed to protect freedom of expression, ruling that free expression must not cause damage to figures in the monarchy and government. Worryingly, the MDES representatives themselves affirmed they could not remember if the lyrics contained the word "king" or not and even admitted that the song did not mention any names.
