⚠️ เมื่อคืนนี้ (14 ม.ค.) สมาคมฟ้าสีรุ้งแห่งประเทศไทยได้โพสต์ชี้แจงความจำเป็นในการดำเนินคดีกับ "ผู้ที่หมิ่นประมาทและก่อให้เกิดความเสียหาย" แก่สมาคมฯ ประกาศฉบับนี้ออกมาเพื่อตอบโต้สมาชิกคณะกรรมการมูลนิธิมานุษยะและนักเคลื่อนไหวเพื่อประชาธิปไตยศิริศักดิ์ ไชยเทศ ที่ตัดสินใจคืนรางวัลปี 2562 หลังสมาชิกสมาคมฯ แสดงความสนับสนุนเวทีเสวนากษัตริย์นิยมของพรรคไทยภักดี
⚠️ แม้จะพยายามอ้างว่าเคารพสิทธิส่วนบุคคล สมาคมฯ ยังกล่าวว่าข้อความของศิริศักดิ์เกี่ยวกับจุดยืนทางการเมืองของนายกสมาคมนั้น ส่งผลกระทบทางลบกับเจ้าหน้าที่และงานที่สมาคมฯ ทำอยู่กับชุมชนผู้มีความหลากหลายทางเพศ ในโพสต์ยังได้อธิบายอีกว่าได้มีความพยายามไกล่เกลี่ยแล้วแต่ทั้งสองฝ่ายยืนยันในหลักการของตน
🚫 มูลนิธิมานุษยะขอประณามการตัดสินใจดำเนินการทางกฎหมายของสมาคมฟ้าสีรุ้งแห่งประเทศไทย และย้ำว่าพวกเขามีหน้าที่เคารพและปกป้องกฎหมายสิทธิมนุษยชนนานาชาติที่ไทยได้ลงนามไว้ คุ้มครองเสรีภาพในการแสดงออก การดำเนินคดี #SLAPP กับผู้ที่ใช้สิทธิอันชอบธรรมนั้นเป็นเรื่องที่ไม่อาจยอมรับได้! การพูดความจริงและยืนหยัดเพื่อชุมชนผู้มีความหลากหลายทางเพศนั้นหาใช่การหมิ่นประมาท ความเสียหายของสมาคมฯ นั้นเกิดขึ้นจากพฤติกรรมเชิงดูถูกของนายกสมาคมที่มีต่อชุมชนผู้มีความหลากหลายทางเพศเท่านั้น นี่ไม่ใช่ความผิดของศิริศักดิ์ นักเคลื่อนไหว LGBTQ+ ทำถูกแล้วที่ออกมาประณามแดนนี่-กิตตินันท์ ธรมธัช ที่ไม่เคารพชุมชุนผู้มีความหลากหลายทางเพศและไม่ยึดถือมาตรฐานสิทธิมนุษยชน
🏳️🌈 เราสนับสนุนการต่อสู้เพื่อประชาธิปไตยและความเท่าเทียมทางเพศของศิริศักดิ์ ไชยเทศอย่างเต็มที่ อุดมการณ์ของพรรคไทยภักดีและรัฐบาลทหารของไทยซึ่งสมาคมฯ แสดงความสนับสนุน ขัดกับหลักการที่เราในฐานะนักสตรีนิยมสายอำนาจทับซ้อน (intersectional feminists) และผู้เคลื่อนไหวเพื่อสิทธิมนุษยชนยึดถือทุกประการ ในหลายปีที่ผ่านมาภายใต้การนำรัฐบาลของประยุทธ์ จันทร์โอชา ผู้มีความหลากหลายทางเพศไทยยังคงไม่มีสิทธิเท่าเทียม อันรวมไปถึงสิทธิ #สมรสเท่าเทียม ที่เวที UPR เมื่อปีที่แล้วได้ขอไว้กับรัฐบาลไทยโดย 4 ประเทศสมาชิก UN (ฝรั่งเศส ไอซ์แลนด์ ลักเซ็มเบิร์ก เนเธอร์แลนด์)

BUT Speaking the Truth to protect the Universal Human Rights of the LGBTIQ+ community is not a Crime!
⚠️ Last night (January 14) the Rainbow Sky Association of Thailand (RSAT) announced on their Facebook Page that they have to sue anyone who has "defamed and caused damage" to the association. This was a response to Manushya Foundation's Board Member and #LGBTIQ+ pro-democracy activist Sirisak Chaited's decision to return his 2018 award after RSAT's President endorsed a royalist panel organized by the Thai Pakdee Party.
⚠️ Claiming they "respect individual rights," RSAT said Sirisak's statement on their President's political stance has affected their employees and their work with the LGBTQIAN+ community. They also explained that they had tried to mediate the matter with Sirisak, but both sides stood their ground.
🚫 Manushya Foundation strongly condemns RSAT's decision to take legal action and recalls their duty to respect and protect International Human Rights Law, including international human rights treaties which Thailand has ratified, that guarantee our freedom of expression. Undertaking a #SLAPP lawsuit against someone who purely exercises this right is unacceptable! Speaking the truth & standing strong for the LGBTIQ+ community is not defamation. The fact that RSAT's work has been impacted is solely the result of their President's undermining behavior towards the LGBTIQ+ community - this is not Sirisak's fault! LGBTIQ+ activists have rightly held Kittinun "Danny" Daramadhaj accountable for his lack of respect for the LGBTIQ+ community and his lack of human rights principles and standards.
🏳️🌈 We wholeheartedly support Sirisak Chaited and his fight for democracy and gender equality. The ideology of the Thai Pakdee party and the Thai military regime, for which RSAT's President has shown support, is against everything We, as intersectional feminists and human rights activists, stand for. After years under Prayuth Chan-o-cha, the Thai LGBTQIAN+ community has yet to gain equal rights, including the right to #MarriageEquality as demanded during Thailand's 3rd UPR Review last year by 4 UN Member States (France, Iceland, Luxembourg, and The Netherlands).
