Labor union activist prosecuted with an Emergency Decree violation
(English below) #LaborRights #SLAPP 🚨 ธนพร วิจันทร์ นักสหภาพแรงงานถูกอัยการยื่นฟ้องฝ่าฝืน พ.ร.ก.ฉุกเฉิน เมื่อวันที่ 6 ม.ค. กรณีพยายามเข้าไปยื่นหนังสื่อต่อรัฐมนตรีกระทรวงแรงงานเพื่อเรียกร้องการเยียวยาจากรัฐบาลเมื่อวันที่ 29 ต.ค. ปีที่แล้ว 👥
✊️ เธอเดินทางไปกระทรวงแรงงานในฐานะตัวแทนลูกจ้างที่เป็นแรงงานข้ามชาติเครือข่ายช่วยเหลือผู้ใช้แรงงานจากสหภาพคนทำงาน (Workers’ Union) เครือข่ายองค์กรด้านประชากรข้ามชาติ (Migrant Working Group) และเครือข่ายแรงงานเพื่อสิทธิประชาชน (Labour Network for Peoples Rights) เพื่อติดตามเรื่องการเรียกร้องครั้งก่อนหน้านั้น ซึ่งพวกเขาได้ขอให้รัฐบาลแก้ไขปัญหาสถานการณ์ภายใต้การแพร่ระบาดของโควิด 19 ของแรงงานก่อสร้างและแรงงานข้ามชาติ รวมถึงขอให้รัฐบาลแสดงความชัดเจนเกี่ยวกับมาตรการการขึ้นทะเบียนของรัฐ ต่อมาศาลมีคำสั่งอนุญาตให้ปล่อยตัวชั่วคราวธนพร
⚠️ ในความเป็นจริง ได้มีการประสานงานกับผู้แทนกระทรวงแรงงานไว้ก่อนการยื่นหนังสือแล้ว กระทรวงแรงงานเองจึงมีหน้าที่อำนวยความสะดวกและดำเนินการตามมาตรฐานการควบคุมโรคเพื่อป้องกันการแพร่ระบาดของโควิด 19 แทนที่จะเป็นเช่นนั้น ธนพรกลับถูกดำเนินคดีในลักษณะการฟ้องปิดปากต่อนักปกป้องสิทธิมนุษยชน (A Strategic Lawsuit Against Public Participation หรือ SLAPP) จากการใช้เสรีภาพในการแสดงออก
🔇 ปีที่แล้วประเทศไทยได้รับคำแนะนำ 18 ข้อ เกี่ยวกับการขอให้ไทยเคารพเสรีภาพในการแสดงออก บนเวทีรายงานสิทธิมนุษยชน Universal Periodic Review (UPR) แม้ไทยจะตอบรับเพียง 7 ข้อ แต่ข้อหนึ่งนั้นขอให้ไทยออกกฎหมายป้องกันประชาชนจาก SLAPP การสั่งฟ้องธนพรถือว่าขัดกับข้อแนะนำนี้โดยตรง ประเทศไทยต้องรับผิดชอบคำสัญญาที่ให้ไว้กับประชาคมโลก!
😷 นอกจากนี้ แม้แรงงานข้ามชาติคิดเป็นร้อยละ 10 ของแรงงานไทย พวกเขากลับต้องถูกรัฐบาลไทยมองข้ามซ้ำแล้วซ้ำเล่า พวกเขาส่วนใหญ่ไม่อาจเข้าถึงเงินเยียวยาและบริการทางสุขภาพที่พวกเข้าต้องการเป็นอย่างมากระหว่างการแพร่ระบาดของโควิด 19 ปัญหาเหล่านี้ได้ยกมาพูดถึงบนเวทีรายงานคณะกรรมการว่าด้วยการขจัดการเลือกปฏิบัติทางเชื้อชาติในทุกรูปแบบ (CERD) เมื่อปีที่แล้ว โดยมีข้อสรุปขอให้ไทยปฏิบัติดังต่อไปนี้
1️⃣ ดำเนินการทุกวิถีทางที่จำเป็นเพื่อขจัดการเลือกปฏิบัติอันทับซ้อนและหลากหลายรูปแบบ รวมไปถึงการเลือกปฏิบัติต่อแรงข้ามข้ามชาติผู้มีความหลากหลายทางเพศ
2️⃣ ลบอคติและการเหมารวมทางลบเกี่ยวกับแรงงานข้ามชาติ ผู้ลี้ภัย และผู้แสวงหาที่ลี้ภัย

#LaborRights #SLAPP 🚨 Thanaphon Wichan, a labor union activist, was prosecuted with an Emergency Decree violation on January 6. Her "crime" stems from her attempt to give the Labor Minister a letter demanding assistance during the pandemic on October 29, 2021. 👥
✊️ As a representative of migrant employees, The Workers’ Union, the Migrant Working Group and the Labour Network for Peoples Rights, she went to the Ministry of Labor to follow up on their previous petition asking for solutions to problems faced by construction and migrant workers during the COVID-19 pandemic, as well as a clarification on the unclear policies on migrant workers' registration process. She was later allowed to post bail.
⚠️ In fact, coordination had been made with representatives of the Ministry of Labour prior to her travel there. It was the Ministry's responsibility to ensure the enforcement of the disease prevention protocol to prevent the spread of COVID-19. Instead of that, Thanaphon Wichan unjustly faced a Strategic Lawsuit Against Public Participation (SLAPP) for simply exercising freedom of expression.
🔇 Just last year, Thailand received 18 Universal Periodic Review (UPR) recommendations that called for the respect of freedom of expression. The government accepted only seven of them, including one that called for the enactment of legal protection against SLAPP cases. Persecuting Thanaphon Wichan is an obvious contradiction of that. Thailand must uphold its obligations to the international community!
😷 Moreover, although making up 10% of the Thai labor force, migrant workers are constantly overlooked by the Thai government. Most of them are unable to get the financial and health support they desperately need during this pandemic. These issues were addressed last year in Thailand's CERD (UN Committee on the Elimination of all Forms of Racial Discrimination) Review. Its concluding observations have urged Thailand to:
1️⃣ Take all measures necessary to combat the intersecting and multiple forms of discrimination, including discrimination against LGBTI migrants.
2️⃣ Eliminate prejudices and negative stereotypes, including against migrants, refugees, and asylum seekers.
