All you need to know about the 'Human Rights of Students' Bill led by Bad Student!





(EN below)📍สิ่งที่คุณควรรู้เกี่ยวกับ “พระราชบัญญัติว่าด้วยสิทธิมนุษยชนของผู้เรียน” ร่างโดยกลุ่มนักเรียนเลว


#นักเรียนเลว #รื้อระบบอำนาจนิยม ✊🏻ตั้งแต่ปี 2564 กลุ่ม “นักเรียนเลว” เป็นหัวหอกสำคัญในการเคลื่อนไหวเพื่อสิทธิของนักเรียน แต่หลังจากผ่านไปปีกว่าๆ การเปลี่ยนแปลงทางรูปธรรมก็ยังไม่เกิดขึ้น กลุ่มนักเรียนเลวจึงเป็นแกนนำในการร่าง “พระราชบัญญัติว่าด้วยสิทธิมนุษยชนของผู้เรียน” ซึ่งเป็นร่างกฎหมายฉบับแรกที่ร่างโดยนักเรียนไทย และเป็นตัวกลางในการรวบรวมรายชื่อเพื่อเสนอเข้าสู้สภาผู้แทนราษฎรต่อไป


🏫หลักการและเหตุผลสำคัญที่ต้องร่างกฎหมายนี้ขึ้นมา ธัญชนก คชพัชรินทร์ ตัวแทนจากกลุ่มนักเรียนเลวได้อธิบายว่า เพราะการแก้ไขพ.ร.บ.การศึกษา 2542 “เข้าข่ายเป็นกฎหมายว่าด้วยการปฏิรูปประเทศ” และเนื้อหาในพ.ร.บ.คุ้มครองเด็ก 2546 “เต็มไปด้วยคำสั่ง ไม่ใช่การสร้างหลักประกันหรือรับรองว่าเด็กนักเรียนในโรงเรียนมีสิทธิอะไรบ้าง”


✍🏻ด้วยเหตุผลเหล่านี้ กลุ่มนักเรียนใหม่จึงตัดสินใจยกร่างกฎหมายใหม่ขึ้นมา โดยร่างพ.ร.บ.สิทธิมนุษยชนของผู้เรียนฉบับนี้แบ่งเนื้อหาออกเป็น 3 หมวด ที่มีเนื้อหาคร่าวๆดังนี้


(1) สิทธิมนุษยชนผู้เรียน

🗣ผู้เรียนมีเสรีภาพในการแสดงออกและการแสดงความคิดเห็น

💖ผู้เรียนมีสิทธิที่จะได้รับการคุ้มครองด้านจิตใจ กระทรวงศึกษาธิการต้องจัดให้มีนักจิตวิทยาหรือนักสังคมสงเคราะห์อย่างเพียงพอเพื่อให้คำปรึกษาตามที่ผู้เรียนต้องการ


(2) สภาพแวดล้อมและสวัสดิภาพ

📍ผู้เรียนจะต้องได้รับสิทธิในความปลอดภัย การลงโทษหรือการปรับพฤติกรรมผู้เรียนต้องเป็นไปเพื่อการพัฒนาศักยภาพผู้เรียนและเป็นไปตามความเหมาะสมเท่านั้น

💗ผู้เรียนมีสิทธิที่จะมีเวลาส่วนตัวสำหรับพักผ่อน เข้าร่วมกิจกรรมที่สนใจ ทำงานอดิเรก หรือละเล่นสันทนาการ โดยสถานศึกษามีหน้าที่ต้องควบคุมเวลาเรียนให้ไม่กระทบต่อเวลาส่วนตัวของผู้เรียน


(3) การมีส่วนร่วมของนักเรียน

👍🏻กำหนดให้สถานศึกษาดำเนินกิจกรรมและกระบวนการส่งเสริมสิทธิมนุษยชนแก่ทั้งผู้เรียนและบุคลากร


📍ร่างกฎหมายฉบับนี้ถือได้ว่า เป็นกฎหมายที่ร่างของนักเรียนโดยนักเรียนเพื่อนักเรียนอย่างแท้จริง มูลนิธิมนุษยะขอเชิญทุกท่านร่วมเป็นส่วนหนึ่งในประวัติศาสตร์การเปลี่ยนแปลงอนาคตของเด็กไทย ด้วยการร่วมลงชื่อเข้าผลัดกัน ร่างพระราชบัญญัติว่าด้วยสิทธิมนุษยชนของผู้เรียน เพื่อเป็นหลักประกันสิทธิและเสรีภาพของนักเรียนไทย เด็กไทยจะได้มีความสุขที่ได้ไปโรงเรียน!

#WhatsHappeningInThailand ✊🏻Since 2020, the student activist group “Bad Student” has spearheaded student rights campaigns. After a year, there has been no visible improvement on the ground. The Bad Student then decided to be a leader in drafting the “Human Rights for Students” Bill and provide a platform for people to sign the petition proposing the Bill to the Parliament.


🏫 According to Bam, a Bad Student member, it is crucial to draft such legislation because the revision of the National Education Bill “would be considered a reform bill" and the content of the Child Protection Act is “mainly regulations. They do not guarantee and state student rights at school.”


✍🏻The Bad Student group then decided to draft a bill titled “Human Rights for Students” consisting of 3 categories:


(1) Student Human Rights

🗣Students have the right to freedom of expression.

💖 Students have the right to mental health. The Ministry of Education has to provide students with counselors and social workers at the request of the students.


(2) Environment and Welfare

📍Schools are required to provide students with a safe environment and ensure students are granted due process before they are punished.

💗Students are entitled to enough time for rest, hobbies, and recreation, and the school is responsible for regulating the number of school hours so that it does not infringe on the private time of students.


(3) Student participation

👍🏻The school must ensure that human rights activities include both students and staff.
